Membership Terms & Conditions

1. Definition and Interpretation

‘DCL’ means Dining Concepts Limited, owner and operator of the membership program as well as its restaurants and other related businesses.

‘Law’ means the governing Law of Hong Kong to which these Terms & Conditions shall be governed by and construed in accordance with.

2. Membership Privileges

2.1 Membership Tiers: DC may from time to time at any time create or modify tiers, types and categories of membership on such terms and conditions as we may determine. DC may also vary or modify the benefits, rewards and privileges associated with the tier of the membership.

2.2 Rewards and Benefits: The rewards as described in the membership kit are merely illustrative and the benefits associated with the membership may therefore vary from what is described in the kit and also vary depending on different promotions.

2.3 Facilities: DC does not guarantee that all facilities will be available to the member at all times and therefore the member is required to comply with any conditions of the operation companies.

2.4 Upgrade: To upgrade the membership to a higher tier, a certain minimum spend must be reached within a certain time period. The minimum spend as well as the time period are open to amendment by DCL. If a certain minimum spend is not reached in the required time period DCL may also downgrade a member to a lower tier.

2.5 Transfer: A member may want to transfer their membership, which can be done by submitting an application to specifying the name of the Transferee to us for approval. Approval is subject to DCL with full discretion wether to accept or reject a transfer application.

3. Operating Companies

3.1 New Venues: New Operating Companies: DCL may from time to time establish or introduce new companies to be included in the membership program.

3.2 Amendment of venues in the program: Equally DCL reserves the right to take certain operating companies out of the membership program.

4. Credit and Stored Value

4.1 Maximum credit: The maximum credit balance per day is $20,000.

4.2 Balance information: The balance information may be found on the web app.

4.3 Validity: The credits obtained expire after 1 year from the date of collection.

4.4 Refund: The credits obtained are non refundable and cannot be exchanged for cash. The credits shall only be used for goods and services consumed at the facilities or provided by DCL.

4.5 Other offers: The credits cannot be earned in conjunction with any other discounts or offers (Asia Miles, DCL Frequent Diner Program, other discounts).

4.6 Credits can not be obtained for private parties or event bookings.

4.7 Obtaining credits: Credits can only be obtained if the membership number has been shared with the cashier before the bill has been settled. Credits cannot be obtained afterwards. Receipts cannot be credited afterwards.

4.8 Dispute: Should any dispute arise, the decision of Dining Concepts remains final.

5. Prohibitions

5.1 Illegal Activities: Illegal activity of any kind is strictly forbidden on DCL premises or facilities.

5.2 Anti-Money Laundering: In order to comply with the money laundering laws, each member gives consent to DCL to conduct checks on the member and to obtain and or disclose or release any information relating to a members membership account.

5.3 Commercial Purpose: No member shall, without the prior written approval of DCL, use any DCL’s premises for any commercial purpose.

5.4 Gambling: Unless permitted by law through a gambling license, gambling of any kind is forbidden on the premisses of DCL.

6. Termination of membership

6.1 No refund of credits: If a member wished to resign, no refund of credits shall be made.

6.2 Record: An account record will be kept by DCL upon a members resignation.

6.3 Termination: DCL holds the right to terminate a membership for reasons that include but are not limited to, violation of the Terms and Conditions, misrepresentation of any information or misuse of the membership, violation of law, fraud or abuse and unreasonable behaviour or disregards of the facilities rules.

7. Force Majeure

7.1 No Liability: DCL will not be liable for failure to perform its obligations in the case of Force Majeur included but not limited to: War, Riot, civil commotion, explosion, fire, power outage, severe floods, droughts, typhoons, earthquakes and other natural disasters or political upheavals.

8. Personal Data

8.1: Data protection: Our members data will be handled by DCL as the data controller in accordance with applicable data protection requirements. DCL will under no circumstance transfer your personal data to third parties.

8.2 Promotions: DCL will send the member information relating latest news, promotion and services of DCL as well as Third Parties that DCL corporates or co-sponsors with.

9. Amendment of Rules

9.1 Amendments: These Terms & Conditions may from time to time be revoked, altered or amended by DCL after which an email will be send out to inform each member about any updates.

10. Effective Date

These Terms & Conditions are effective as of 1 June 2018 and shall govern all Memberships until it is amended, varied or supplemented by DCL.
